Terms and Conditions of Use and Sale

1. Definition of terms

Where we use the words You or Your it means the customer. We, Us or Our means The Old Cellar Ltd.

2. Prices and product information

The prices of all products are clearly stated on www.theoldcellar.com. In case an item has been under-priced, we will not be liable to deliver this item to you at the stated price and you will be notified before it is despatched to you. If you decide not to proceed with the order at the correct price, a full refund will be issued to you.

All prices include VAT (unless otherwise stated) but exclude delivery charge. The delivery charge will be calculated at the time and date of placing the order.

3. Availability and back orders

We aim to always stock the full range of the products on our website. However, if for any reason your item is not in stock or we are unable to supply it to you, we will place it on back order for you. You will always be contacted as soon as possible with the option to cancel your order if you would rather not wait.

4. Bulk Buy Policy

5. Payment and acceptance

Payment must be made when an order is placed. Once you are charged, you cannot amend your order.

We accept payments by Mastercard or Visa credit or debit card and Maestro. We do not accept any other types of card, e.g. Visa Electron.

Your credit/debit card details will be encrypted by the theoldcellar.com website to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. If there is a problem taking payment for all or part of your order we will contact you by email (or by telephone if you have not given us an email address).

By placing an order with us, you make an offer to buy from us. Your offer is only accepted by us when we despatch the item(s) to you. No contract exists at any point before that. If we are unable to supply an item to you, we will notify you and will arrange a full refund of any amount already paid by you (see section 9).

We will not sell alcohol to anyone under the age of 18. You cannot transfer an order to someone else. By placing an order, you confirm that you and the person to whom it will be delivered are aged 18 years or over. An age-verification check will be carried out upon delivery of alcohol. No supply of alcohol will be made to a person under 18 years of age and a drunken person as this is against the law and so The Old Cellar Ltd may refuse the sale at point of delivery on these grounds.

6. Delivery

At present we deliver goods to UK Mainland only. We use our own transport and third parties to supply our products.

Delivery will be made to the address specified in the order. Alcohol will only be sold and delivered to an individual address or business address where there is an account set up for such a sale.

  • Free UK delivery on all orders over £100 
  • There is a shipping fee of £8.95 for any orders under £100

We try to deliver all items within the requested time frame, but we will not be liable to do so in case of circumstances beyond our control. We will contact you to inform you if some or all items will not be delivered on time.

For a Time slot delivery, if no one aged 18 years or over is at the address when the delivery is attempted, the goods will be retained by the driver who will leave a notification of attempted delivery and will telephone to rearrange another delivery later that day or on a different day. In these circumstances, if we have to return to deliver the items, a further delivery charge may become payable. If we are unable to make a second attempt to deliver the items, they will be returned to us and you will then be refunded for the cost of the goods less the delivery charge or a fee of £8.95 for orders with free delivery. In such case, you will have to place a new order for the items.

Deliveries of alcohol cannot be left outside the address if no one is present at the time of delivery.

7. Cancellations and complaints

You have the right to cancel an order within 14 days from receipt of an item by contacting us on 07716737680 or by sending an email to [email protected].

If the order has been despatched and you have taken the delivery, you will be given a refund once the supplied items have been returned to us. In this case you must follow our returns policy as per section 8. Otherwise, you can refuse to accept the delivery so that the items will be returned to us and we will then issue a refund.

If you would like to make a complaint or a suggestion please send an email to [email protected] providing as much detail as you can. We aim to review to all complaints within 48 hours from their receipt and try to resolve them within a further 72 hours.

8. Returns policy

If for any reason you change your mind and would like to return an item within 28 days of receipt, we’ll refund the full amount of the item or exchange it. You must arrange for the item to be returned to us or arrange collection.

We will provide a full refund or replacement for any drinks that are faulty when the faulty item is returned to us.

In order to arrange collection, you can contact us on 07716737680 or send an email to [email protected]. We are not able to collect any broken bottles and we can only collect items in their original packaging. If you have removed and disposed the packaging, you have to order a replacement at an additional cost before collection of an item. Any drinks must be returned intact and unopened and only full and complete cases can be returned.

9. Refund policy

In case you are entitled to a refund, it will be made to the card used to make the purchase.

10. Liability/Our responsibility

We agree to be responsible for any losses or damages you may suffer as a result of our breach of these Terms and Conditions only to the extent that these losses are reasonable foreseeable. We cannot be liable for business losses including data and profits.

11. Privacy policy

The Old Cellar Ltd does not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

When you register at our website you will receive a password. We do not keep track of this password. It is your responsibility to keep it secret. You are entirely responsible for all orders placed with us or information given to us under your e-mail address in combination with your password. You must immediately info us of any unauthorised use of your registration details or any breach of security known to you.

For the purposes of the prevention or detection of crime and disorder, and/or the apprehension or prosecution of offenders, we may share any information that we collect with the Police, other public or private sector agencies or representative bodies in accordance with the relevant legislation. Information shared in this way will not be used for marketing purposes.

The Old Cellar Ltd confirms that it conforms with the requirements of the Data Protection Act 1998.

12. Security Policy

The Old Cellar Ltd is responsible for all website card transactions. Card details are entered on a secured page and are processed by secure servers using SSL. We do not capture card details on our own site. If you give us your card details directly, they are destroyed once payment has been made. We do not retain your card details in any format.

Our Payment Service Provider is Worldpay. Worldpay provides a secure payment gateway, processing payments for thousands of online businesses, including ours. It is Worldpay’s utmost priority to ensure that transaction data is handled in a safe and secure way.

Worldpay uses a range secure methods such as fraud screening, I.P address blocking and 3D secure. Once on the Worldpay systems, all sensitive data is secured using the same internationally recognised 256-bit encryption standards.
